1. Introduction

Welcome to Marketonics (the “Platform”), operated by Skysoft IT Services Pvt. Ltd. (“we,” “us,” or “our”), a CMMI Level 3 and ISO 27001:2013 certified company. By accessing or using Marketonics, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, please refrain from using the Platform.

2. Definitions

  • Company: Refers to Skysoft IT Services Pvt. Ltd., the provider of the Marketonics platform.
  • Platform: Refers to Marketonics, the business automation and CRM solution developed by the Company.
  • User: Any individual or organization using the Platform.
  • Services: Refers to the features offered through Marketonics, including CRM, automation tools, customer engagement, messaging, and analytics.

3. Eligibility

  • You must be at least 18 years old to use the Platform.
  • By registering an account, you confirm that you have the legal authority to enter into this agreement.
  • You agree to provide accurate, complete, and current information during registration.

4. Account Registration and Security

  • To access certain features, you must create an account with unique login credentials.
  • You are responsible for safeguarding your account credentials.
  • The Company reserves the right to suspend or terminate accounts found to be involved in unauthorized activities.

5. Services and Usage

Marketonics provides a suite of tools and services to streamline business operations, including:
  • Lead and customer relationship management (CRM)
  • Workflow automation and task tracking
  • Email, WhatsApp, and SMS communication modules
  • Reporting and analytics dashboards
Access and functionality depend on assigned roles (e.g., Admin, Executive, Manager).

6. Data Privacy and Security

  • We are committed to protecting your personal and organizational data in compliance with GDPR, ISO 27001:2013, and other applicable data protection standards.
  • Data is securely processed and used solely for delivering and improving services.

7. Subscription and Payment

  • Subscription Fees:

    Some features of Marketonics require a paid subscription. All pricing details are available in your service agreement.

  • Renewals and Cancellations:

    Subscriptions automatically renew unless canceled before the renewal date.

  • Late Payments:

    Access to services may be suspended in the event of non-payment.

8. Intellectual Property

  • All content, code, designs, trademarks, and intellectual property related to Marketonics are owned by Skysoft IT Services Pvt. Ltd.
  • You are granted a limited, non-exclusive license to use the Platform for authorized business purposes only.
  • Any unauthorized use, copying, or redistribution is strictly prohibited.

9. Messaging and Notifications

Marketonics may send automated notifications through:
  • WhatsApp, Email, and SMS
These messages may include:
  • User activations and access links
  • Reminders for tasks, attendance, and approvals
  • Announcements and updates
Users may opt out of certain communications by contacting help@marketonics.com.

10. User Responsibilities

  • Access or attempt to access the Platform in unauthorized ways
  • Share login credentials or sensitive data with unauthorized individuals
  • Use the Platform for illegal or unethical purposes
  • Violate any applicable data protection laws

11. Data Protection Standards

  • As an ISO 27001:2013 certified organization, Skysoft ensures high standards of data protection.
  • Users may request access to or deletion of their personal data.
  • Users may opt out of marketing messages at any time.

12. Limitation of Liability

  • Skysoft IT Services Pvt. Ltd. shall not be liable for:
    • Data loss due to user negligence
    • Downtime or service disruptions caused by third-party providers
    • Indirect, incidental, or consequential damages
  • Total liability is limited to the subscription fees paid in the last 12 months.

13. Termination of Services

  • Suspend or terminate access for violations of these terms
  • Modify or discontinue the Platform or its features at any time
  • Retain necessary user data as required by law post-termination

14. Governing Law and Jurisdiction

This agreement is governed by the laws of India. Disputes arising from this agreement shall be subject to the jurisdiction of the courts in Uttar Pradesh, India.
